CLUBS IN EUROPEAN SUPPER LEAGUE CANNOT BE BANNED FROM FIFA, UEFA GAMES – COURT

Uefa and Fifa cannot block the launch of a new European Super League, a Spanish court has ruled.

A dozen leading European clubs have committed to forming a breakaway competition that they hope will rival the Champions League.

Both the world and European governing body have voiced their intention to take action against both clubs and players involved in any competition with potential suspensions or expulsions mooted.

But a preliminary ruling by a Spanish commercial court in Madrid on Tuesday states that neither Fifa or Uefa or any associated football body can take “any measure that prohibits, restricts, limits or conditions in any way” the launch of the league until the court has fully considered the case.

The Premier League are “considering all actions” against the six English clubs – Liverpool, Manchester City, Manchester United, Chelsea, Tottenham and Arsenal – who intend to join the competition after a meeting of the other 14 clubs on Tuesday

NDC INSPECTS ORIGINAL COPIES OF TECHIMAN SOUTH ELECTION RESULTS IN COURT

The Electoral Commission (EC) has provided the original pink sheets on the 2020 parliamentary elections held in the Techiman South constituency to the National Democratic Congress’ (NDC) parliamentary candidate, Christopher Beyere Baasongti for inspection.

This is in compliance with a court order given at the last sitting last week.

The court had ruled that the original documents should be presented to Beyere for inspection but according to him, the EC provided photocopies instead.

The court therefore awarded a cost of GHS2,000 in favour of the petitioner, Christopher Beyere, due to the Electoral Commission’s failure to properly produce the documents as directed by the court

The EC was also instructed to ensure that the original copies are made available by 2pm on April 19, 2021.

Reports suggested that the EC reported at the court about an hour late to file the original documents.

The NDC, in arriving at the court on Monday, April 19, 2021, came with a generator and a photocopier to assess the documents.

Michael Tsatsu Axolu reports that the EC’s filing process was nearly marred by a power outage at the court but the NDC was able to assess the documents.

Meanwhile, the General Secretary of the National Democratic Congress, Johnson Asiedu Nketiah says there are still some issues with the documents filed.

“This is just a simple process of the EC producing originals of some documents for our inspection, so we have inspected them and done some photocopies. The contents will be discussed when they are in the witness box.”

“They have provided us with documents, but we believe there are issues around those documents…We knew there could be a power outage so we came prepared with our photocopier and our generator so the lights going off couldn’t have stopped the process,” he added.

ARMED ROBBERS ATTACK MOMO AND ELECTRICAL SHOP

Two men on a motorbike have robbed a mobile money vendor and an adjacent electrical shop at Opeikuma, a suburb of Kasoa in the Awutu Senya East Municipality.

The two men reportedly entered the mobile money shop around 11 am on Monday and demanded money from the vendor before fleeing.

According to the attendant at the mobile money shop, the robbers made away with an unspecified amount of money and fired a warning shot when passersby were alerted and tried to intervene.

One of the victims, in an interview narrated that “there were three phones being charged and [one of the robbers] instructed us to squat. He then forcefully took the other girl’s bag, and picked up the three phones which were being charged on the floor.”

She spoke of her terror during the attack, stating emphatically;”I don’t want to trade by the roadside again because of the gun that I saw. He might come around again and hurt me. When they were leaving after the robbery, I raised an alarm of robbery and he gave me a stern look which scared me.”

The electrical shop attendant said that the armed man took away their money and phones upon several threats.

“He asked for our money but we were hesitant and replied that we had no money. When he continued demanding money, I took out the bag containing the money, which he snatched and emptied. He was wielding a gun behind me and asked me to move into the shop. He demanded their money and took away a lot of phones that were being charged. He demanded more money from me, slapped me and threatened to shoot me if I raised an alarm. Later, he instructed us to sit on the ground.”

She added that “he leapt onto a motorbike [which had a rider] and they sped off.”

This incident comes three weeks after a 40-year-old man, Steven Ntire, was shot at Opeikuma Junction by unknown assailants on a motorbike, who also made away an undisclosed amount of money.

JOSE MOURINHO SACKED

Jose Mourinho has been sacked by Tottenham Hotspur after 17 months in charge of the club.

The Portuguese replaced Mauricio Pochettino as Spurs manager in November 2019 and guided the club to sixth in the Premier League last season.

They are currently seventh, having picked up two points from their past three league games, and were knocked out of the Europa League in March.

Spurs face Manchester City in the Carabao Cup final on Sunday.

AIRTEL TIGO SHARES AND ASSETS TO BE TRANSFERRED TO GHANA GOVT

The government of Ghana has signed an agreement with telecommunications company AirtelTigo for the transfer of ownership to the state.

The government of Ghana and the parent companies of AirtelTigo, Bharti Airtel Ghana Holdings B.V., MIC Africa B.V signed the transfer after they concluded negotiations to transfer the shares of the company to the Ghana government.

The transfer of ownership comes after AirtelTigo in June 2020 announced its decision to exit the Ghanaian market.

This agreement transfers all customers, assets, and agreed liabilities of AirtelTigo to the government of Ghana.

“We consider this a positive step as it adds to the growing portfolio of digital infrastructure assets being utilized by the government,” Communication Minister Mrs. Ursula Owusu-Ekuful stated.

Mrs. Ursula Owusu-Ekuful signed on behalf of the government of Ghana, while Ms. Jatina Catharina Uneken-van de Vreede, Mr. Martin P Frechette, Mr. Timothy Pennington, Mr. Eric Nana Nipah, and Mr. Vish Ashiagbor signed on behalf of the seller entities.

AKUAPEM POLOO LAWYERS CONSIDERING REVIEW OF JUDGEMENT

Rosemond Brown’s lawyer has not ruled out an appeal against the 90-day jail sentence handed to his client for posting a nude photo of herself and her seven-year-old son on social media.

Speaking to the media after the sentencing on Friday, April 16, 2021, her lead counsel, Andrew Vortia said appealing the ruling “is an option for us…For me, I want to go for an appeal.”

He said he was waiting for the full judgment of the case before proceeding with the next line of action.

“I have written for the judgment. If I have it by the close of the day, by 9 am on Monday [April 19] I will file an appeal,” he told the press.

Rosemond Brown, widely known as Akuapem Poloo, was given the 90-day jail term following her conviction on charges of publication of obscene material and domestic violence.

She pleaded guilty to all three charges on Wednesday and was convicted on her own plea by the court.

Her lawyer had made a mitigation plea to ask for a more lenient punishment.

Mr. Vortia maintained that the custodial sentence handed out was harsh.

“The mitigating factors in her favour are greater than the aggravating factors. When you consider this offence, it is not rape. It is not murder. It is a misdemeanour in which she could have been dealt with lightly,” he said.

The lawyer also questioned the lack of concern for Rosemond Brown’s seven-year-old son.

“Social welfare should have been bought in. We are protecting the child. The mother is gone, so who takes care of the child? Absolutely nothing was done to that effect,” Mr. Andrew said.

The judge, Christina Cann, bemoaned the spate of nudity on the Ghanaian social media space when she handed the sentence on Friday.

According to her, the punishment meted out to Rosemond Brown must serve as a deterrent to others.

TECHIMAN SOUTH: COURT GRANTS NDC CANDIDATE LEAVE TO INSPECT EC DOCUMENTS

The Wenchi High Court in the Bono Region has granted the Techiman South National Democratic Congress (NDC) 2020 parliamentary candidate, Christopher Baasongti Beyere, leave to inspect the Electoral Commission’s original documents for the 2020 general elections.

The judge has set Monday 19 April 2021 for all parties to be present for the exercise.

The judge ruled that only original copies of the documents will be inspected.

In addition, the court gave the Commission three days to properly file the documents for the inspection exercise to be done on the adjourned date.

Also, the Wenchi High Court has awarded a cost of GHC2,000 in favour of the petitioner Beyere after the EC failed to properly produce documents as earlier directed by the court.

Meanwhile, the court has also ordered the Electoral Commission’s Returning Officer for Techiman South, Nana Dwamena Frempah, to answer interrogatories filed by the petitioner.

Beyere had sued the MP for the area, Martin Adjei-Mensah Korsah, the Electoral Commission and the Clerk to Parliament over what he describes as false representation of the results from that constituency.

Reliefs
In his suit filed at the Wenchi High Court, he prayed the court to compel the EC to quash its decision of declaring Korsah of the New Patriotic Party (NPP) as the winner of the Techiman South parliamentary elections.

He also wants the Electoral Commission to be compelled to collate polling station results in the constituency in the presence of the representatives of the candidates as well as declare him the winner of the parliamentary poll

AKUAPEM POLOO COULD SERVE UP TO 3 YRS IN JAIL – LAWYER

Ghanaian actress and social media sensation, Rosemond Brown, popularly known as Akuapem Poloo, could be jailed for a maximum of three years when the Accra Circuit Court sits on Friday.

An Accra Circuit Court, presided over by Mrs. Christiana Cann, convicted the social media star after she pleaded guilty in court on Wednesday, April 14, 2021, for posting obscene photos of herself and her seven-year-old son in June last year.

According to private legal practitioner, Bernard Owiredu Donkor, Akuapem Poloo can only face a maximum sentence of three years as her offence was a misdemeanour.

He added that her lawyers could argue to have her sentence reduced.

Rosemond Brown was remanded into police custody to enable her undergo a pregnancy test ahead of her sentencing on Friday, April 16, 2021.

Mr. Owiredu Donkor, in an interview on Eyewitness News, said the court’s order for a pregnancy test on the convict suggests that she will be handed a custodial sentence.

“The offence she was charged with is a misdemeanour, and with a misdemeanour, you could be fined, you could be cautioned, and you could go a for a custodial sentence. But when a judge directs that you take a pregnancy test, as they do for female convicts, it means that we are in for a custodial sentence because the idea is that you don’t put a pregnant woman in jail,” he said.

He added that Akuapem Poloo’s lawyers will need to push forward a strong case to emphasize the adverse impact it would have on her son if she is put in jail and if the judge finds reason in the argument, she could reduce the sentence.

“Counsel is supposed to make a submission on behalf of the convict, which we call a plea of litigation, for the court to avert its mind to certain circumstances of the convicted person…If the judge finds that the plea for mitigation is something that she could consider, it could come in to mitigate the sentence.”

“For misdemeanours, it is between a caution and a maximum of 3 years…Looking at the circumstances we have right now, I wouldn’t be surprised if she is given a custodial sentence, and it could be one day to three years,” the lawyer said.

GHANA TO LOOSE EU COCA MARKET DUE TO DUMSOR

The European Union (EU) is threatening to ban cocoa from Ghana if the negative impact of illegal mining on the country’s environment persists.

Making a presentation at the ongoing National Consultative Dialogue on Small Scale Mining in Accra today, April 15, 2021, the Deputy Chief Executive in-Charge of Agronomy and Quality Control at COCOBOD, Dr. Emmanuel Agyemang Dwomoh, expressed fears about the impact of the development on Ghana’s cocoa sector.

Currently, Ghana exports 80 percent of its cocoa to the European Union.

But Dr. Emmanuel Agyemang Dwomoh said immediate action must be taken to avert the possible sanctions.

“As we speak, EU is threatening to ban Ghana and Côte d’Ivoire, to impose legislative instrument restrictions on the importation of cocoa from Ghana and Côte d’Ivoire to their courts.”

He said the EU is taking this course of action because areas shown in satellite images to have been forested in the 70s and 80s in Ghana have all experienced land degradation in the decades since.

“When you take the satellite images, you will see those places in red. The EU thinks that all those places are red because cocoa is causing land degradation [in Ghana], meanwhile, it is as a result of the galamsey activities.”

He further raised concerns about the devastating effects of the galamsey activities on the production of cocoa in Ghana and its exportation.

“The impact of these mining activities on cocoa production is enormous. There is crop loss, reduction of crop yield and income, loss of vegetation, the fertility of the crop soil is destroyed and [there’s also] an early dropping of immature pods, as a result of the chemicals that they use,” he lamented.

In January 2021, the European Union announced that it will contribute €25 million to enhance the economic, social and environmental sustainability of cocoa production in Côte d’Ivoire, Ghana and Cameroon who are, respectively, the first, second and fifth-biggest cocoa producers, generating almost 70% of the world production.

This funding is to strengthen the partnership between Team Europe (composed of the EU, its Member States, and European financial institutions) and the three cocoa-producing countries and aims at ensuring a decent living income for farmers, halting deforestation and eliminating child labour.

POLICE GUNNED DOWN A SUSPECTED ROBBER INVOLVED IN TAKORADI MARKET CIRCLE KILLING

One person suspected to be connected to the Takoradi market circle robbery has been shot dead by police.

One other person was arrested as part of the Wednesday evening operation.

The operation was conducted by a team of officers from the Western Regional Criminal Investigations Department, together with SWAT officers from the Accra Regional command.

According to a police communiqué, they closed in on the suspects at Elmina, along the Cape Coast-Takoradi road.

In an attempt to arrest the suspects, a shootout ensued and one of the suspects, identified as Shankiki, aged about 30 years, was gunned down whilst two others managed to escape on a motorbike.

A blue motorbike was recovered from the scene of the operation by police.

Police later located the hideout of the suspects and a search was conducted.

One live and one spent AK-47 ammunition, a live tortoise and a talisman were recovered.

A suspect, Inusah Fuseini, aged 25-years, who was at the hideout was arrested for interrogation.

The body of the suspected robber has been conveyed to the police hospital morgue for preservation and autopsy.

Police say efforts are underway to arrest those on the run for interrogation.

The robbery, on April 12, left 61-year-old, Charles Kwakye Agyako, dead after he was shot in the chest by the robbers on motorbikes after withdrawing money from a bank.

The Western Regional Police Command had offered a GHS10,000 bounty for information on the robbers.
