SEIZURE OF ECOBANK ASSETS DUE TO A GHC10M DEPT STOPPED

0

Officials of Ecobank Ghana at its Head Office in Accra, on Tuesday, July 21, stopped the attempted seizure of the bank’s assets by police officers and bailiffs who were there to enforce a High Court order over a debt the bank owes a private entity.

In a court order sighted by Livingavenuegh.com dated June 2, 2020, the Police was to provide assistance to bailiffs which includes Mike Agbemashior, George Tykhonov and Yury Shelkov to execute a writ in which Ecobank Ghana is commanded to make a payment of GHS4 million with an accrued interest of GHS10 million dating back to the year 2015 to Yuri M Plastics, which is the fourth defendant in the case.

According to the court, the order was as a result of a fraud committed against the plaintiffs.

It therefore indicated that the GHS4 million should be paid to the fourth defendant.

Per information gathered by Livingavenuegh.com, an official with the Yuri M Plastic products secured a loan from the Ecobank in the name of the plastic company.

Without due diligence, Ecobank approved the loan. As attempts by Ecobank to retrieve the loan proved futile, it secured a court order which permitted it to take control of the plastic company. With time, the Plastic company also sued Ecobank and demanded damages.

Dr. Daniel Kassertee however confirmed that the bank had been in court over the payments.

“Certainly, the bank has been in court with a certain individual who was not in court with the bank. He was in court with his own company and also the bank. At the end of the day, the bank was asked to pay some money to the company, not the individual. We have since done that, and the court has fixed a date in October to take a decision,” Mr. Kassertee said.

HIGH COURT DISMISSES BoG CASE AGAINST UNICREDIT, AWARDS PENALTY

0

A three-member panel of the Court of Appeal has dismissed an application for Stay of Proceedings by the Bank of Ghana (BoG) in an action instituted by HODA Holdings following the revocation of the license of UniCredit Savings and Loans.

The panel chaired by Justice Welbourne with support from Justice Eric Kyei-Baffour and Justice N C A Agbevor said the BoG failed to demonstrate any special circumstances to convince the Court to exercise its discretion in their favour.

The court after dismissing the application also awarded a cost of GHc2000 against BoG in favour of HODA Holdings.

The court said they have read all the processes filed by the parties and also listened to the oral application by the respective counsel, and dismissed the application considering all the relevant laws relating to such applications.

PROCEEDINGS AT THE HIGH COURT

On May 20, 2020, the Human Rights Division of the Accra High Court presided over by Justice Gifty Agyei Addo dismissed an application by the BoG seeking to halt proceedings in a case initiated against it by HODA Holdings.

The Central Bank was challenging the decision of another High Court that dismissed their claim earlier that the High Court lacked jurisdiction to hear the action instituted by HODA Holdings, challenging the revocation of the license of one of its subsidiary companies, Unicredit Savings and loans.

In the ruling of the High Court, it said the application is dismissed because the applicant (BoG) has not demonstrated the irreparable damage it will suffer should the respondent (applicant) HODA Holdings succeed.

The dismissal of this application has now paved the way for the hearing of the substantive case filed by HODA Holdings to commence at the High Court on July 23, 2020.

THE SUBJECT OF DISCUSSION

It would be recalled that, in October last year the High Court dismissed an application by lawyer of the BoG, Frank Davies, seeking to strike out a case filed by UniCredit challenging the revocation of its license.

The High Court in its ruling indicated that its jurisdiction has been properly invoked in the matter and subsequently ordered the Bank of Ghana, to file a response to the application brought by the owners of Unicredit Savings and loans.

The Court also awarded a cost of GH¢3000 against the Bank of Ghana to be paid to Unicredit savings and loans and another GH¢2000.00.

Bank of Ghana being dissatisfied with the ruling of the High Court proceeded upstairs to the Court of Appeal to quash the High Court ruling because the central bank believed the matter should have been handled at an arbitration level before proceeding to court.

$35 MILLION SPENT ON COVID-19 TESTING IN GHANA – DEPT. HEALTH MINISTER

0

The Government of Ghana has as of July spent $35 million on testing 346,990 COVID-19 suspected cases.

Dr Bernard Okoe Boye, a Deputy Miniser of Health who represented the Minister of Health, made this report to Parliament on Ghana’s COVID-19 situation, in Accra, on Monday.

He said the cost of one Polymerise Chain Reaction (PCR) test on average was U$100 for a suspected case.

The PCR tests were used to detect the genetic information of the virus and also gives an indication of the person who is infected with the disease, he added.

According to him, Ghana has done 346,990 tests with a positivity rate of 7.9 percent.

He said the number of tests done per million of a country’s population gives an indication of the commitment of the country towards fighting the pandemic.

He added that, the higher the test per million population, the more reliable the picture painted for that country.

As of July 16, 2020, Ghana’s case count stood at 27,667, with 148 deaths, 23,249 recoveries with an active case count standing at 4,270.Ghana’s mortality rate deducing from the statistics was 0.5 percent. This means for every 1,000 cases of COVID-19, Ghana could record five deaths.

However, Ghana’s COVID-19 death rate remains one of the lowest in the world, adding that the more efficient management of COVID-19 in a country, the lower the mortality rate.

Alhaji Inusah Fuseini, Member of Parliament (MP) for Tamale Central, in a remark charged Ghanaians to interrogate government for its handling of the pandemic since the disease does not discriminate in terms of one’s party colour, affiliation, and economic status.

“Ghanaians have a responsibility to interrogate what government is doing because COVID-19 does not attack as a result of one’s party colour, affiliation and economic status,” he added.

He urged the citizens to hold government accountable in terms of monies approved by the legislature to help fight the disease.

Dr Nana Ayew Afriyie, Member of Parliament for Asokore, lauded the government for the effective management of the Coronavirus disease.

He said the country’s mortality rate, which was low, was not just by divine intervention, but as a result of good decisions, better protocols and the structures put in place by the government.

Dr Afriyie praised the Government for maximizing the resources allocated to the pandemic efficiently but however challenged skeptics on the performance of the Government to rather applaud it for putting in measures to contain the disease, with a mortality of 0.5 percent.

Other countries have average mortality rates above one percent, Dr Afriyie pointed out and said that of Ghana was not just divine intervention, but real decisions that had translated into that achievement.

It should be noted that The USD 35 M  amount is exclusive of money spent on the expansion of testing capacity.

0

Finance Minister Ken Ofori-Atta says the government is working to roll out unemployment benefits for Ghanaians soon.

According to him, the move has been influenced by how conditions of some workers have been affected because of the coronavirus pandemic.

“As a responsible society we should have such a program to cushion Ghanaians when needed,” he said.

Why this program and how it would be financed?

Speaking on PM Express on JOY NEWS the Minister said the fine details would be announced in the Mid-Year Budget Review set to be presented to Parliament on July 23 2020.

He stated that this assistance is needed to support those workers that had been impacted by coronavirus.

Mr. Ofori-Atta maintains that as a government they are committed to offering some assistance vulnerable in society.

However, a major concern would be how this program would be financed.

Stimulus Package for businesses and Industries.

The minister also noted that the government would roll out another set of stimulus package for businesses.

This should be captured under its Covid-19 Alleviation program, which would be coming out with policies and programs that would fast track the economic recovery.

The minister was of the view this program would also help mitigate the impact of COVID 19 on the economy.

The government earlier this year rolled out its much talked about ¢1 billion stimulus package for small businesses.

This was aimed at assisting small firms that have been badly hit by the coronavirus.

The next round of stimulus package according to the minister, would target large firms in the country.

COVID 19 and Economy

The Finance Minister noted that the current state of the economy showed demonstrated some level of resilience even in the midst of Covid-19.

Mr. Ken Ofori- Atta cites the current inflation rate and Cedis performance as evidence that shows that the economy is resilient even at this time.

Ghana’s economy is projected to grow by about 1.5% according to the Minister.

However, the Bank of Ghana is more optimistic about growth this year as it has projected a little over 2% growth for the country before the end of 2020.

Statistics show Gov't is successful at COVID-19 fight

Minister of Information, Kojo Oppong Nkrumah has discredited the claim that the government’s COVID-19 response strategy has failed.

Oppong Nkrumah at a press conference on Sunday, July 19, said statistics have revealed the successes that have emerged from the government’s measures to contain the virus.

“This year is an election year, there is a lot of politics in the atmosphere so you will find some persons deliberately seeking to contort the analysis of the data, seeking to claim that the COVID-19 response is a failure but the devil is in the details. If you look at the detail of the numbers that are coming out, you can clearly tell the successes that are coming out.”

Don’t take solace in improving numbers

The Minister said although the country had recorded significant strides in the fight against COVID-19, it is imperative for Ghanaians to continually abide by the safety protocols to curtail the spread of the virus.

“What we need to reiterate is that people should not take solace in improving numbers to be reckless. We need to maintain our vigilance so that we can continue our proven track record.”

Measures to curtail COVID-19 spread

The government introduced some measures to stop the spread of the novel Coronavirus after the first two cases were detected in Ghana.

These measures – making the wearing of masks mandatory, restrictions on public gatherings, closure of borders, were aimed at limiting the spread of the virus.

In June, the government also outlined safety measures to guide institutions in tackling the spread of the virus at their premises after case management data had shown that corporate Organizations were recording more cases at the time.

The enhanced protocols included the restriction of employees with mild coughs and cold from the workplace, rotation of employees, and a reduction in internal meetings.

Meanwhile, six hundred and seven (607) new COVID-19 new cases have been recorded in Ghana.
